The Constitutional Court has rejected the application regarding the cumulative pensions of Artsakh residents

In November, a group of members of the National Assembly submitted an application to the Constitutional Court concerning the cumulative pensions of Artsakh residents, which has been rejected. This was announced in a Facebook post by Gegham Stepanyan the former Human Rights Defender of Artsakh. The primary reason for the rejection, as stated in the Constitutional Court’s decision, was the lack of legal substantiation.

The application challenged a provision amended by the National Assembly in June 2024. According to this law, the accumulated funds of Artsakh residents were transferred to Armenia’s cumulative pension system without their consent.
What does this mean?

Residents of Artsakh who worked there had a portion of their salaries accumulated in a pension system to support their future needs. The MPs argued in the application that this law violates the right of Artsakh residents to manage their property at their discretion.

They emphasized that the law should have provided an option for Artsakh residents who obtained residency in Armenia and started working under an employment contract to transfer their shares from Artsakh to another fund upon their request.
